〔記者阮怡瑜彰化報導〕「偷」摸女生下體，非「強制」行為，法院不受理公訴？
廁所下方空隙偷襲
彰化地檢署日前提起一宗妨害性自主公訴案，被告在速食店廁所利用隔間下方空隙，伸手到隔壁間偷摸女學生的下體，但法院認為此舉未達妨害性自主要件，案件屬於告訴乃論的性騷擾防治法中「強制觸摸罪」，因此，不受理公訴罪，檢方24日提出上訴。
地院判決指出，去年12月間，32歲的劉姓男子躲進員林鎮中山路一家速食店的女生廁所，並利用廁所隔間下方空隙達10公分、且為蹲式馬桶的設計，趴在地上，伸手偷摸隔壁間一名正在如廁中女學生的下體，女學生尖叫、奪門而出後，劉嫌隨後被一群見義勇為的高中生逮捕，檢方偵辦後，依刑法妨害性自主之強制猥褻罪嫌提起公訴。
院方指未產生強制力
法院偵辦後，認為強制猥褻罪的構成要件為加害者施以「強制」行為，足以壓制被害人性自主權；但根據該案，加害人伸手觸摸女學生下體僅約1、2秒的時間，女學生一尖叫，被告立即縮手，其行為未產生強制力，時間相當短促，在被害人顯現其不從之意願前，行為已終止，因此屬於性騷擾防治法的「強制觸摸罪」。
認定性騷強制觸摸罪
法官判決指出，性騷擾防治法強制觸摸罪係告訴乃論罪，被害女學生已與被告和解，並撤回此部分告訴，至於妨害性自主公訴部分，因不構成要件，因此不受理此公訴。
對此，檢方不服，提出上訴指出，被害女學生遭偷摸的「同時」已有反應並尖叫，被告的行為並非完全處於「趁人不備」下產生的無強制力行為，法院判決尚不恰當，依法提出上訴。
