廁所下方空隙偷襲
彰化地檢署日前提起一宗妨害性自主公訴案,被告在速食店廁所利用隔間下方空隙,伸手到隔壁間偷摸女學生的下體,但法院認為此舉未達妨害性自主要件,案件屬於告訴乃論的性騷擾防治法中「強制觸摸罪」,因此,不受理公訴罪,檢方24日提出上訴。
地院判決指出,去年12月間,32歲的劉姓男子躲進員林鎮中山路一家速食店的女生廁所,並利用廁所隔間下方空隙達10公分、且為蹲式馬桶的設計,趴在地上,伸手偷摸隔壁間一名正在如廁中女學生的下體,女學生尖叫、奪門而出後,劉嫌隨後被一群見義勇為的高中生逮捕,檢方偵辦後,依刑法妨害性自主之強制猥褻罪嫌提起公訴。
院方指未產生強制力
法院偵辦後,認為強制猥褻罪的構成要件為加害者施以「強制」行為,足以壓制被害人性自主權;但根據該案,加害人伸手觸摸女學生下體僅約1、2秒的時間,女學生一尖叫,被告立即縮手,其行為未產生強制力,時間相當短促,在被害人顯現其不從之意願前,行為已終止,因此屬於性騷擾防治法的「強制觸摸罪」。
認定性騷強制觸摸罪
法官判決指出,性騷擾防治法強制觸摸罪係告訴乃論罪,被害女學生已與被告和解,並撤回此部分告訴,至於妨害性自主公訴部分,因不構成要件,因此不受理此公訴。
對此,檢方不服,提出上訴指出,被害女學生遭偷摸的「同時」已有反應並尖叫,被告的行為並非完全處於「趁人不備」下產生的無強制力行為,法院判決尚不恰當,依法提出上訴。
